No one can recognize more emphatically than I do that most gardens are well managed. But in a large number of gardens abuses are prevalent. I know of cases where contracts of sickly and unfit labourers have been cancelled for the purpose of keeping down the rate of mortality of Act labourers and of others where deaths have been treated as desertions for the same reason. I know of cases where it was the practice to expel sickly coolies who had become unfit for labour. I have seen with my’ own eyes a Government hospital full of sickly and dying contract coolies who had just been eliminated from his garden by one of the oldest and most respected tea-planters in the province. I know of cases in which coolies in the fourth year of their agreement were not paid the higher rates of salary to which they were entitled. In other cases, rice has not been provided at the statutory rate, and the subsistence allowance prescribed by law has not been paid to sick coolies or pregnant women…A case occurred lately in which a coolie woman who had escaped from a garden was recaptured and flogged and another in which a coolie who was suspected of helping others to abscond was flogged. Still more lately a case came to my notice in which coolies were confined for days in what was described as a “prison-house” on the garden and were mercilessly beaten. I must add that these bad cases have not occurred on bad gardens only. Some of the worst were reported from gardens which field a good dividend and are under the control of most respectable boards of management (Cotton, “Letter to the Editor,” The Times, September 11, 1902)।

The Governor-General in Council is glad to acknowledge that the relations between the great majority of planters and their coolies are of a kindly nature, that the planter takes a humane interest in the well-being of the families amongst whom he lives and with whom he is in almost daily contact, and that the coolies look to their employer with the regard which is ordinarily felt by Indian servants for their masters. Instances of oppression are unhappily not altogether rare, and the Governor-General in Council entirely sympathizes with the Chief Commissioner in the desire that they should be severely dealt with. But he sees no reason to find in them a stigma which should apply to the planting community as a whole (Government of India to the Indian Tea Association, February 5, 1902, Cotton’s private 121 papers, BL, IOR, Mss Eur/D1202/3)।
